1. Who We Are and What This Document Covers
Stratacka ("the Agency," "we," "us," or "our") is a creator management and digital services agency currently operating as a partnership firm under the laws of India, with its principal place of business in Kerala, India. The founders intend to register the entity as a Limited Liability Partnership, at which point these Terms will be updated to reflect the registered entity details.
These Terms of Service ("Terms") govern your access to and use of our website ("the Website"), including any forms, waitlists, or information requests submitted through it.
Important distinction: These Terms govern your use of this Website only. If you enter into a paid service engagement with the Agency, that engagement is governed by a separate, individually drafted Service Agreement signed between you and the Agency. In the event of any conflict between these Terms and a signed Service Agreement, the Service Agreement prevails.
By accessing or using this Website, you agree to be bound by these Terms. If you do not agree, please do not use this Website.
2. Eligibility
This Website is intended for use by content creators, streamers, and individuals interested in creator management services who are:
- At least 18 years of age, or the age of majority in their jurisdiction if higher; and
- Capable of entering into a legally binding agreement under Indian law.
If you are under 18, you may only use this Website with the verifiable consent of a parent or legal guardian. We do not knowingly collect information from individuals under 18 through our waitlist or contact forms without such consent.
3. Nature of Our Services
3.1 Website is informational
The Website describes the categories of services we offer, our pricing tiers, our growth approach, and our agency philosophy. Nothing on this Website constitutes a binding offer, guarantee, or contractual commitment to provide services to any visitor.
3.2 We are a selective agency
We operate on an outbound model. We approach creators we have identified as candidates based on our own channel research and audits. Submitting a waitlist form or interest form through this Website does not:
- Guarantee that we will contact you;
- Guarantee that we will accept you as a client;
- Create any obligation on the Agency to provide any service; or
- Constitute a service agreement of any kind.
3.3 Tier E (Exclusive Roster) — by invitation only
The Exclusive Roster tier described on this Website is available by invitation only, issued solely at the Agency's discretion. No application, waitlist, or payment will secure access to this tier. Any representation to the contrary — whether from a third party or a fraudulent communication claiming to be from us — should be reported to us immediately.
3.4 Legal services — important limitation
The people behind this Agency have a legal background and are not enrolled advocates under the Advocates Act, 1961. Services described under Section C (Legal & DMCA) — including DMCA response assistance, fair use documentation, contract review, and IP documentation — are provided as administrative and consultancy support, not as legal advice from a licensed practitioner of law. For legal matters requiring representation before a court or formal legal opinion, we recommend engaging a qualified advocate.
4. Waitlist and Interest Forms
4.1 What happens when you submit a form
When you submit an "I'm interested" or "Join waitlist" form on this Website, you are expressing interest in a service tier. Submission:
- Adds your information to our internal records for that tier;
- Authorises us to conduct an independent review of your publicly available channel data;
- Does not create a service agreement, payment obligation, or guaranteed engagement; and
- Does not entitle you to priority access, refunds, or any compensation if the tier does not launch.
4.2 How we use your submission
We use the information you submit to:
- Assess whether your channel profile is a strong candidate for the tier you expressed interest in;
- Contact you with a personalised communication when the tier becomes available, if we believe you are a suitable candidate;
- Maintain records of demand for specific tiers to guide our service expansion decisions.
We will not use your submission to send unrelated marketing communications, and we will not sell or transfer your submitted data to any third party for commercial purposes.
4.3 Withdrawal of interest
You may withdraw your waitlist submission at any time by emailing us at [email protected]. Upon withdrawal, we will remove your information from our waitlist records within 14 days.
5. Growth Guarantee
5.1 Scope
The growth guarantee described on this Website — including the refund structure — applies only to clients who have signed a formal Service Agreement with the Agency that includes an agreed growth target, a documented channel baseline, and explicitly incorporates the guarantee terms.
5.2 Guarantee is conditional
No guarantee of growth, viewership increase, subscriber gain, or revenue improvement is made to any visitor of this Website by virtue of browsing or submitting a form. The guarantee is binding only when:
- A Service Agreement has been signed by both parties;
- A specific, numerical growth target has been documented and countersigned;
- The channel baseline has been recorded on the contract commencement date; and
- The creator has fulfilled the minimum activity and compliance conditions set out in the Service Agreement.
5.3 Refund conditions
Refund conditions are set out in individual Service Agreements and not on this Website. The descriptions on this Website are illustrative of our general approach and do not constitute a binding commitment.
6. Intellectual Property
6.1 Website content
All content on this Website — including text, layout, design, graphics, and copy — is the property of Stratacka or its licensors and is protected under the Indian Copyright Act, 1957. You may not reproduce, copy, distribute, or use any part of this Website's content for commercial purposes without our prior written consent.
6.2 Content produced under a Service Agreement
Clips, edits, graphics, and any other content produced by the Agency on behalf of a client under a Service Agreement are subject to the intellectual property terms of that specific agreement. In general:
- All content produced by the Agency is embedded with an invisible digital watermark using ScoreDetect technology, containing a unique identifier tied to the Agency and the client.
- This watermark constitutes evidence of the Agency's role in producing the content and survives re-encoding, cropping, and compression.
- Ownership and licensing terms for produced content are defined per client in the relevant Service Agreement.
- Continued use of Agency-produced content after contract termination, without a written licensing agreement, may constitute copyright infringement under the Indian Copyright Act, 1957, Section 51.
6.3 Client's original content
We do not claim ownership over a creator's original streaming content, gameplay footage, live recordings, or independently created material. Our watermark applies only to content that our Agency directly produces, edits, or transforms.
7. Third-Party Platforms and Tools
The Agency uses third-party tools and platforms in delivering its services, including but not limited to: Eklipse, Opus Clip, CapCut, Buffer, Later, ScoreDetect, Social Blade, VidIQ, TubeBuddy, Razorpay, and Stripe. Use of these tools is subject to their respective terms of service and privacy policies. We are not responsible for the actions, policies, or service interruptions of any third-party platform.
The Agency works across YouTube, Twitch, Kick, TikTok, and Instagram. Our ability to deliver services is dependent on the continued availability, policy stability, and API access of these platforms. Changes to platform algorithms, monetisation policies, or Terms of Service are outside our control and may affect service delivery.
8. Prohibited Uses
You agree not to use this Website to:
- Submit false, misleading, or fraudulent information in any form;
- Impersonate another creator, person, or entity;
- Attempt to gain unauthorised access to any system or data held by the Agency;
- Scrape, copy, or republish the Website's content for commercial purposes;
- Use automated tools (bots, crawlers, scrapers) to interact with forms or systems on this Website;
- Submit requests that violate the terms of any third-party platform referenced herein; or
- Engage in any activity that is unlawful under the Information Technology Act, 2000 or any applicable Indian law.
9. Disclaimers and Limitation of Liability
9.1 No warranty
The Website and its content are provided "as is" and "as available." We make no warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.
9.2 Accuracy of information
While we endeavour to keep the information on this Website accurate and current, we do not guarantee that all information — including pricing, tier availability, and service descriptions — is complete, accurate, or up to date at any given time. Pricing and tier availability are subject to change without notice.
9.3 Limitation of liability
To the fullest extent permitted by applicable Indian law, the Agency, its founders, employees, and partners shall not be liable for:
- Any indirect, incidental, consequential, or punitive damages arising from your use of or inability to use this Website;
- Any loss of data, revenue, goodwill, or business opportunity;
- Any reliance placed on information displayed on this Website; or
- Any unauthorised access to or alteration of your transmissions or data.

Disputes arising from individual Service Agreements are governed by the dispute resolution clause in the respective Service Agreement, which may include mandatory prior negotiation and, if unresolved, referral to arbitration or court proceedings in Kerala.
